Sewer Rate Increase
Per Ordinance 2018.32
Effective January 1, 2016, the sewer user charges to all classes of sewer users shall be increased by 5% per 1,000 gallons of flow being discharged into the sanitary sewer system. The resulting charge is as follows:

AN ORDINANCE PROVIDING FOR INCREASING USER FEES FOR THE WASTEWATER TREATMENT SYSTEM OF THE VILLAGE OF SUNBURY
WHEREAS, Council of the Village of Sunbury has previously specified user fees and charges to be charged for the treatment and disposal of wastewater for Sunbury area customers; and
WHEREAS, the most recent increase was provided for on or about June 17, 1998 per Ordinance 98-020; and
WHEREAS, Council has contracted for and been provided with a user fees rate study which has identified a need to provide for increased user fees to meet the expenses incurred in the collection, treatment and disposal of wastewater for Village of Sunbury customers; and
WHEREAS, Council has additionally been advised that the existing segregation of fees between user charges and debt service charges is inconsistent with current operations and should be discontinued;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Sunbury, Delaware County, Ohio:
SECTION I: The Village of Sunbury Codified Ordinance 925.05(a) is hereby amended to read as follows effective January 5, 2009:
925.05 SEWER USER CHARGES
(a) The following User Charges shall be paid by all classes of users (defined
in Section 925.04) throughout the service area effective January 5, 2009,
and the charges shall be based on each 1,000 gallons of flow being
discharged into the sanitary sewer system:

SECTION II: Effective January 1, 2010 and January 1st of each subsequent calendar year for a period of 8 years ending on January 1, 2017, the sewer user charges to all classes of sewer users shall be increased by 5% per 1,000 gallons of flow being discharged into the sanitary sewer system. The resulting charges are as follows:

SECTION III: The Village of Sunbury Codified Ordinance 925.03(a) is hereby amended to read as follows:
DESCRIPTION OF SERVICE CHARGES
(a) The service charges shall consist of a user charge, extra strength user surcharges, where applicable, and connection charge. The user charge is payment to the Municipality by all recipients of sewer service for treatment of "normal strength" wastewater or wastewater of less than "normal strength".
It is designed to offset the cost of operation and maintenance to the collection and treatment facilities, including cost associated with equipment replacement. The user charge is intended to enable the Sewer Department to be financially self-sufficient with respect to operation and maintenance of its facilities.
(b) For wastewaters which exceed "normal strength", the user shall pay extra strength user surcharges, as specified herein under Section 925.06 in addition to the other sewer service charges specified in this chapter for "normal strength" wastewater.
(c) This section is hereby deleted.
SECTION IV: It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in open meetings of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
WHEREFORE, this Ordinance shall take effect at the earliest time permitted by law.
